Freedom of information (FOI)

The Freedom of Information (Scotland) Act 2002 gives you the right to request information from the Crofting Commission. We must provide it unless there’s a good reason not to.

How to request information

Requests must be in writing (which includes email). Send your request to:

Crofting Commission, Great Glen House, Leachkin Road, Inverness, IV3 8NW or by email to compliancehub@crofting.gov.scot with “FOI” in the subject line.

Please include your name, a postal address or email address for our reply, and a phone number if you can.

You can also find our guidance on vexatious or repeated requests , and more information on your rights at the Scottish Information Commissioner’s website.

Fees and timescales

  • Will there be a fee? We do not usually charge for requests. However, we may charge a fee if your request places a significant demand on our staff or finances. You can read our Charging Policy for details.
  • Timescale: We will respond to your request within 20 working days. If a request is complex, we will contact you to explain the delay and let you know when you can expect a full response.

What to do if you’re unhappy with our response

  • Request a review: If you are not happy with our response, you can ask for a review within 40 working days. We will look at your request again and aim to provide a new response within 20 working days.
  • Appeal to the Scottish Information Commissioner: If you are still not satisfied, you have the right to appeal to the Scottish Information Commissioner. You should keep all your correspondence with us, as you will need to provide copies to the Commissioner.

Before making a request for information

We already have a large amount of information available on this website, via our Publication Scheme which can be found below and in our Annual Report. You can also find many publications, information on consultations and Board papers.  We recommend that you look through this website first before requesting information as it may already be available.

  1. FOI Request: 144305 (EIR)

    request for the completed original historical document that references the Secretary of Estate as proprietor and includes tenant names, rent amounts and crofting status within reference to the Crofters (Scotland) Act 1955 and any other associated crofting registered entries covering the Parish of Kilchrenan & Dalavich Argyll.

    1 When was the house at 7 Teavarran was decrofted, maybe around 1976? 2 South Teavarran the croft, was an amalgamation of a number of crofts. Teavarran: 7, 6, half of 5; and Ruifour: 8 and half of 7. When did this happen, though it was obviously sometime during Lovat possession - prior to 1986. 3 There is another house apparently on the former croft 5, and next to Ruifour, which Rosemary Dingwall, who bought that property sometime between 1975 and 1978, insisted was the original 7 Teavarran. This house is now occupied and has been renamed 7 Teavarron. • This Lovat map of 1871 shows the crofts and part crofts that formed South Teavarran. My house is circled on the right, on croft 7. That on the left is the original croft house for croft 5, and against the boundary of 7. The other '7 Teavarran' does not show on this map. • This OS map of 1901 shows the house at the end of the Ruifour track on croft 5, and below it is the old water mill. The site of the original croft 5 house is marked with a cross. It is barely visible today. • The South Teavarran croft map shows the 2 houses excluded, and the site of the previous croft 5 house. • When was this other house decrofted, is it actually a replacement for 5 Teavarran, and any other information that might explain why this house has the same number as mine. My 7 Teavarran was occupied by Alexander McDonald until 1982, as a demolition order was placed on the building, and several years after the other one was purchased as 7 Teavarran. 4 Also request for any relevant historic information regarding the above, and in particular concerning croft 7.

    Request for all records held regarding this croft between June 1992 and the present day. Specifically, information on: 1. Applications for Division: Was an application ever submitted by the executor of the estate (or any other party) to divide this croft between 1992 to the present date? 2. Consent and Notification: If a division occurred, was the Commission's formal consent granted, and were the other joint beneficiaries of the will notified of this application? 3. Owner-Occupier Status: Who has been officially recorded in the Register of Crofts as the owner-occupiers since the date of death (21/06/1992)? 4. Recent Changes: Any records relating to the recent transfer of ownership to Mrs Caroline Milne, including whether this was a notified ""subsequent event."

Information pertaining to funding agreements, contracts or document held by the Commission in regards to any LGBT organisation that has LGBT+ issues as its main purpose.
