The Freedom of Information (Scotland) Act 2002 (FOISA) gives you the right to request information from the Crofting Commission. We must provide it unless there’s a good reason not to.

Before Making a Request for Information

Before making a formal request, please explore the large amount information already available on our website, including the Publication Scheme, Annual Reports, Publications, and Board Papers. If you are specifically looking for details regarding individual crofts, croft lists or associated individuals, you can find this via our Open Data and our Register of Crofts. While we are committed to transparency and providing information whenever possible, please also keep in mind our guidance on vexatious and repeated requests and our Charging Policy.

How to Request Information

Requests must be in writing and must include:

  • Your full name
  • A contact address – this can be a postal or email address
  • A description of the information you want

If possible, please provide a daytime telephone number so we can contact you if we have any questions about your request.

To request information you can email or write to us with “FOI” or “Freedom of Information” in the subject line or body of the request.

Fees and Timescales

  • Will there be a fee? We do not normally charge for providing this information. You can read our Charging Policy for details.
  • Timescale: We will respond to your request within 20 working days. If a request is complex, we will contact you to explain the delay and let you know when you can expect a full response.

Review and Appeal – what to do if you’re unhappy with our response

  • Request a review: If you are not happy with our response, you can ask for a review within 40 working days. We will look at your request again and aim to provide a new response within 20 working days.
  • Appeal to the Scottish Information Commissioner: If you are still not satisfied, you have the right to appeal to the Scottish Information Commissioner. You should keep all your correspondence with us, as you will need to provide copies to the Commissioner.

    Request for an internal review of Crofting Commission's handling of 'FOI Request For Vacant Crofts'. The request plainly asks for a list of vacant crofts sorted by region along with the contact details of the owner or managing authority. No specification of whether or not those crofts were classified legally vacant but used by a non-resident owner were made and thus this distinction is out of the remit of this request.

    Request for all the information held by the Commission in whatever form (written, digital, cartographic, oral) relating the Clashmore and Raffin Common Grazings. In particular I should like to have sight of any recent correspondence between the Commission and any representative of the committee or shareholders. Equally I would like to know what may have been said in conversation with any of your officers, and the above mentioned, and would also like to see copy of their notebooks, aides memoires or whatever method is now used to record such information.
