Freedom of information (FOI)
The Freedom of Information (Scotland) Act 2002 gives you the right to request information from the Crofting Commission. We must provide it unless there’s a good reason not to.
How to request information
Requests must be in writing (which includes email). Send your request to:
Crofting Commission, Great Glen House, Leachkin Road, Inverness, IV3 8NW or by email to compliancehub@crofting.gov.scot with “FOI” in the subject line.
Please include your name, a postal address or email address for our reply, and a phone number if you can.

Fees and timescales
- Will there be a fee? We do not usually charge for requests. However, we may charge a fee if your request places a significant demand on our staff or finances. You can read our Charging Policy for details.
- Timescale: We will respond to your request within 20 working days. If a request is complex, we will contact you to explain the delay and let you know when you can expect a full response.
What to do if you’re unhappy with our response
- Request a review: If you are not happy with our response, you can ask for a review within 40 working days. We will look at your request again and aim to provide a new response within 20 working days.
- Appeal to the Scottish Information Commissioner: If you are still not satisfied, you have the right to appeal to the Scottish Information Commissioner. You should keep all your correspondence with us, as you will need to provide copies to the Commissioner.

Before making a request for information
We already have a large amount of information available on this website, via our Publication Scheme which can be found below and in our Annual Report. You can also find many publications, information on consultations and Board papers. We recommend that you look through this website first before requesting information as it may already be available.
We are strongly committed to complying with legislation that gives you the right to request information and for that information to be provided to you unless there are good reasons not to do so. In November 2020 the Crofting Commission granted an application to decroft multiple (two) building plot sites at 3 Fiscavaig in spite of the fact that the existing crofters were in breach of Crofting Commission rules. In correspondence with Kate Forbes about this matter, Mairi Gougeon cited a response from the Crofting Commission as follows: The Crofting Commission is aware of the concern expressed regarding multiple decroftings on a croft but must make decisions that are consistent with the legislation and previous decisions of the Scottish Land Court regarding decrofting applications. In short the Crofting Commission is required to balance the interests of the applicant with the interests of the croft, the crofting community and the public interest. If the Commission finds on the evidence that any particular decrofting application will have a materially adverse impact on the croft or the crofting community, it will consider refusing the application. Request for an internal review of Crofting Commission's handling of 'FOI Request For Vacant Crofts'. The request plainly asks for a list of vacant crofts sorted by region along with the contact details of the owner or managing authority. No specification of whether or not those crofts were classified legally vacant but used by a non-resident owner were made and thus this distinction is out of the remit of this request.
