How to appoint an agent

If you want another person or organisation to handle your business with the commission, you can appoint them as an agent.

Types of agents

We place agents into three categories:

  • Legal agents: Solicitors who can be checked through the Law Society. They can be a single person or a group.
  • Professional agents: An organisation or person who provides a paid service.
  • Non-professional agents: Anyone who acts for a crofter without being a legal or professional expert, such as an individual family member, friend, or neighbour.

A valid power of attorney always takes priority. If you have this document, no other mandate is needed, however if the holder of the power of attorney wishes to use a non-professional agent then a mandate will still be required for them.

Do you need a mandate?

  • Legal agents: No mandate is needed.
  • Professional agents: A mandate is not normally needed, but we may ask for one if we don’t know the agent. We will let you know after we receive your application form.
  • Non-professional agents: A mandate is always required.

Submitting forms

A mandate [link to form] is a form you use to give non-professional agents permission to represent you. You should submit a separate mandate for each application where one is needed.

When a mandate is needed, both the crofter and the agent must sign the mandate form. We accept digital or scanned copies of signed forms, including photos as long as they are clear and legible.

Note: The rules for using an agent with the commission may not be the same as those for Registers of Scotland. You should check their specific requirements.
