Information requested

Request for: information between the Crofting Commission, Commissioner MacLennan and the Ethical Standrds Commission; information which relates and demonstrates procedures for a Special Meeting; and information on the notice of the special meeting given to members of the Commission.

Response

​In this instance an exemption under Section 30(b)(i) and 30(b)(ii) applies under the Act, as well as Section 38(1)(b). The Section 30 exemption relates to the information being of a confidential nature and to information in draft form. The Section 38 exemption relates to the personal information of a third party. In respect of Section 30, the public interest test has been applied and it has been judged that the public interest is best served by maintaining the exemption to disclosure at this time. At a later date, when the information is no longer in draft form, it may be possible to re-visit this decision.Once the draft Minute of the Special Meeting which took place in Brora on 28 September 2016 has been approved, this will provide the information which matches your request. However, as at point 1, an exemption under Section 30(b)(i) and (ii) applies at this time because the Minutes have yet to be approved and made available to the public.
