Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
Request for review of case 2.26.55510 regarding withholding information under legal professional privilege. Also a request for the total number of tenancies which have been assigned to new tenants since 1 October 2011.
Response
In conclusion of the review conducted on this request the information exempted from the original enquiry did qualify as legal professional privilege on the basis that it constituted communications between the Commission and its legal advisers. Having reached this conclusion we then carried out a balancing exercise weighing the public interest in withholding the legally privileged information and the public interest in disclosing the information. Having carried out the assessment we have concluded that any public interest in disclosing the information is outweighed by the strong inherent public interest in maintaining legal professional privilege in relation to these communications. We therefore have concluded that the exemptions where applied appropriately in this case.
