If a particular condition – say that the area in respect of which the direction has been made is to be fenced off- has a time limit attached to it what is the effect, if any, of failing to comply with the time limit?

If the Commission are satisfied that there has been a breach of a condition they can make a further direction that the land in respect of which there has been a breach shall be a vacant croft: Section 25(3) However the Commission cannot make a further direction if more than 20 years have elapsed since the direction was issued, or the land has since been conveyed to a person other than the former crofter or a member of the former crofter’s family: or a debt is for the time being secured by way of a standard security over, or over any real right in, the land or any part of it.
