Exchange of Croft Land

Tenant crofters can apply to the Commission to exchange croft land providing:

The croft land, and/or any grazing shares, they want to exchange have the same landlord, and the landlord of the crofts agrees to the exchange.

Please note that there MUST be an exchange of croft land for BOTH crofts subject to the application or the application is not valid and will be returned.  i.e. CROFT A must exchange land with CROFT B and CROFT B must exchange land with CROFT A.

A straightforward approval can be made if:

  • Both tenants are complying with their statutory duties relating to residence and land use.
  • Demand has not been expressed for the tenancy of either croft
  • There have been no objections
  • The exchange will not create any access issues
  • There are no concerns over the size and quality of either croft resulting from the exchange.

 If any of these conditions are not met, the application will be escalated.          

 

Please ensure you submit your Registers of Scotland (RoS) Registration Application form along with your application, if required.

Please note that when you are completing the Registration Application for RoS you are required to advise them of persons who own/occupy any adjacent croft or land, as our ROC is not mapped based the Commission cannot assist you with this information.
